General terms and conditions of sale
The www.bindiatelier.com website (hereinafter referred to as the "Site") is published by BINDI ATELIER, a limited liability company with capital of 1000 euros, registered with the Lille Trade and Companies Register under number 840 104 905, with its registered office at 4 allée des Grands Champs 59650 Villeneuve d'Ascq.
The www.bindiatelier.com website is hosted by OVH, a company registered with the Roubaix Trade and Companies Registry, whose head office is located at 2 rue Kellermann 59100 Roubaix - France.
Article 1. Purpose
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the two parties, within the exclusive framework of the relations that they establish on the Internet, concerning any online sale of the Products offered on the Site. They regulate all the stages necessary for placing an order and ensure the follow-up of this order. These terms and conditions apply to the exclusion of any other document.
Article 2. Characteristics of the goods and services offered
The BINDI ATELIER products offered for sale on the Site are decorative items, accessories and printed textile items. All these products are available subject to stock availability; we also reserve the right to limit the quantity of products supplied, to deliver only part of an order or to split orders, as well as to modify the terms or period of validity of any special offer or promotion. If any of the Products are unavailable, we will inform you as soon as possible. We guarantee the authenticity of all the products offered for sale on the Site.
Article 3. Prices
The prices indicated on the BINDI ATELIER website are in EURO, all taxes included. Despite our efforts to display accurate prices on the site, errors may occur. If we detect an error in the price of the goods you have ordered, we will give you the choice of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. The prices shown do not include shipping and delivery costs. The user will be informed of these when the order is finally confirmed. The value added tax is that in force in France at the time of the Order.
Article 4. Methods of payment
Payment for products may be made by bank card (Visa, Carte Bleue, Mastercard) or by Paypal. For credit card payments, BINDI ATELIER has selected the Payplug secure payment solution. At the time of the Order, when the customer must enter or communicate their card number and its validity date, they will be on the Payplug system's secure network. These numbers are never known or kept by BINDI ATELIER. After verification and approval by the banking centre, the customer automatically returns to the Site to continue shopping in complete security. The customer's bank account will be debited within 48 hours from the date of the order, which will be considered effective after confirmation of the bank's agreement. The customer's card will be debited in euros only.
Article 5. Modifications & Cancellations
If you wish to cancel or modify your order, please send an email as soon as possible to: serviceclient(at)bindiatelier.com. We will do our best to accommodate your request. However, please note that orders are processed as quickly as possible and once an order has been placed we cannot guarantee that it will be cancelled or amended. On receipt of your online order, please refer to the returns instructions included in your parcel. Article 6. Shipping & Delivery
Except in exceptional circumstances, purchases are shipped by La Poste, Mondial Relais or DHL. Orders are processed and delivered from Monday to Friday, excluding public holidays. BINDI ATELIER cannot be held responsible for unforeseen delays. Article 7. Returns & Exchanges
The customer has a withdrawal period of 15 days following the date of delivery of the products ordered.products ordered at the normal price must be returned within 15 days following the date of delivery; on sale products, these must be returned within 10 days of delivery.returns will be processed as soon as possible and at the latest within 30 working days following receipt of the request. BINDI ATELIER will accept refunds on goods provided they are in their original condition and accompanied by their original sales invoice. Please note that we cannot accept worn, used, altered or damaged goods. The full amount of the returned product will be credited back to the credit card used to pay for the product. Your credit card account will be credited when the returned product is processed and the credit will appear on your next statement.
Please note that shipping charges are non-refundable unless BINDI ATELIER made an error in the original delivery. We recommend that you send the merchandise by insured and/or tracked parcel post for better tracking. BINDI ATELIER will not provide refunds or compensation in the event that returned packages are lost, stolen or damaged during transport. BINDI ATELIER reserves the right to refuse returns of any goods that do not meet the above criteria.
As part of occasional commercial or marketing operations, Bindi Atelier may offer free products with purchase (for example: a gift with any order or for purchases over a certain amount). In the event of a full or partial return of an order that qualified for a free gift, the customer agrees to return the free gift as well, in its original, unopened packaging and in new condition. If the free gift is not returned, or if it is returned damaged or used, Bindi Atelier reserves the right to deduct the commercial value of the gift from the total refund amount.
Article 8. Errors & Inaccuracies
We make every effort to provide complete, accurate and up-to-date information on our website. However, we cannot guarantee that a website will be free from human or technical error. This site may contain typographical errors, inaccuracies or omissions, including pricing and availability, and product information. We will do our utmost to correct these errors, inaccuracies or omissions, including after an order has been sent, and to modify or update this information at any time without prior notice.
Article 9. Personal information
The personal information collected in the context of online sales is necessary for the processing of orders and their delivery, as well as for invoicing. This information is strictly confidential and is not disclosed to third parties. Any missing information will result in the automatic refusal of the order. In accordance with Act 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, all personal information collected on the Site has been registered with the CNIL (Commission Nationale de l'Informatique et des Libertés). BINDI ATELIER cannot be held responsible in the event of a breach of security, unless said breach was attributable to negligence on the part of BINDI ATELIER.
Article 10. Liability
BINDI ATELIER cannot be held responsible for any inconvenience or damage inherent in the use of the products sold on this Site. The sole obligation of BINDI ATELIER, concerning access to the site, the processing of orders, delivery or subsequent services, is limited to an obligation of means. BINDI ATELIER cannot be held responsible for any inconvenience or damage inherent in the use of the Internet network, in particular interruption of service, external intrusion or the presence of computer viruses.
Article 11. Archiving - Proof
Bindi Atelier will archive the invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized records of Bindi Atelier will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Article 12. Settlement of disputes
The terms and conditions of sale, as well as the contractual relationship between BINDI ATELIER and the user are governed by French law. The parties accept the jurisdiction of the courts of Lille (France) for any action brought as a result of or in connection with these terms and conditions of use.
